  10. This file provides information for Shareware Distributors, Disk Vendors and 
  11. Computer Clubs and User Groups who wish to distribute any or all of the 
  12. Cascoly programs ANTIC, ATC, FICTIONARY, GREEN, BORDER, QUILT, CAPBUF, 
  13. CRYPTIK, EGA ECOMASTER, PEG, SUPER VGA PUZZLE, PALETTE PLEEZER, TOWERS, 
  14. BIBLE TIMELINE, UDECIDE, WEBS and CHRONOS.  These programs will be referred 
  15. to below as Cascoly Shareware. Program names may not be changed without 
  16. special permission, except for the following special cases if your system 
  17. supports only 6 character names:

  76. Obtaining current copies of Cascoly Software:

  78. ASP vendor and BBS members automatically receive upgrades of individual 
  79. Cascoly Shareware programs through the ASP group mailings.  Anyone can 
  80. receive a complete set of current programs (listed in the README.LST or 
  81. CATALOG.COM files) at a cost of $15 for shipping and handling.  (If you send 
  82. seven 3½" disks and a self addressed, stamped mailer, we waive the shipping 
  83. charge).  This package contains distributable versions of the programs, plus 
  84. descriptive information useful for catalogs and other advertising.

  91. Individuals who wish to distribute Cascoly Shareware to friends or 
  92. associates may do so in accordance with the restrictions outlined in 
  93. LICENSE.DOC.

  95. Limited Distribution License:

  98. As the exclusive copyright holder for ANTIC, ATC, GREEN, FENCE, TOWERS, 
  99. WEBS, FICTIONARY, BORDER, CAPBUF, CRYPTIK, ECOMASTER, PEG, SUPER VGA PUZZLE, 
  100. PALETTE PLEEZER, BIBLE TIMELINE, QUILT, UDECIDE, XFIRE, and CHRONOS, Cascoly 
  101. Software authorizes distribution only in accordance with the following 
  102. restrictions.  Please refer to the additional information listed below which 
  103. is specific to ASP and non-ASP Disk Vendors, Computer Clubs, and Disk-of-
  104. the-Month style distribution. 
  105.  
  106. Individual Cascoly Shareware programs are defined as containing all the 
  107. material listed in the PACKING.LST text file.  If any files listed in the 
  108. PACKING.LST text file, or the PACKING.LST file itself, are missing, then the 
  109. package is not complete and distribution is forbidden.  
  110.  
  111.     o  A Cascoly Shareware package - including all related program files and 
  112.        documentation files - CANNOT be modified in any way and must be 
  113.        distributed as a complete package, without exception.  (Either the 
  114.        ZIP or self extracting EXE file must be used.  This is the sole 
  115.        exception for modification -- you can use an alternate archiving 
  116.        program.)  The PACKING.LST text file contains a list of all files 
  117.        that are part of the Cascoly Shareware package.  
  118.  
  119.     o  No price or other compensation may be charged for a Cascoly Shareware 
  120.        package.  A distribution cost may be charged for the cost of the 
  121.        diskette, shipping and handling, as long as the total (per disk) does 
  122.        not exceed US$8.00 in the U.S. and Canada, or US$12.00 
  123.        internationally. 
  124.  
  125.     o  The Cascoly Shareware package CANNOT be sold as part of some other 
  126.        inclusive package.  Nor can it be included in any commercial software 
  127.        packaging offer, without a written agreement from Cascoly Software.  
  128.        For information on combining the Cascoly Shareware package with 
  129.        related programs to form a "disk-set", please refer to the 
  130.        information below for ASP or non-ASP Disk Vendors.

  132.     o  Cascoly Shareware cannot be "rented" or "leased" to others. 
  133.  
  134.     o  The person receiving a copy of a Cascoly Shareware package MUST be 
  135.        made aware that each disk or copy is ONLY for evaluation, and that 
  136.        Cascoly Software has not received any royalties or payment for the 
  137.        product.  This requirement can be met by including the complete 
  138.        Cascoly Shareware package, which contains appropriate registration 
  139.        reminders. 
  140.  
  141.     o  The person receiving a copy of Cascoly Shareware MUST be made aware 
  142.        that he or she does not become a registered user until Cascoly 
  143.        Software has received payment for registration of the software.  This 
  144.        requirement can be met by including the complete Cascoly Shareware 
  145.        package, which contains any appropriate registration reminders. 
  146.  
  147.     o  Licensee shall not use, copy, rent, lease, sell, modify, decompile, 
  148.        disassemble, otherwise reverse engineer, or transfer the licensed 
  149.        program except as provided in this agreement.  Any such unauthorized 
  150.        use shall result in immediate and automatic termination of this 
  151.        license.

  153.     o  U.S. Government Information:  Use, duplication, or disclosure by the 
  154.        U.S. Government of the computer software and documentation in this 
  155.        package shall be subject to the restricted rights applicable to 
  156.        commercial computer software as set forth in subdivision (b)(3)(ii) 
  157.        of the Rights in Technical Data and Computer Software clause at 
  158.        252.227-7013 (DFARS 52.227-7013).  The Contractor/manufacturer is

  165. The following additional information and restrictions are intended for 
  166. Shareware Distributors, Disk Vendors, and Computer Clubs who wish to 
  167. distribute Cascoly Shareware.

  169. ASP Associate (Disk Vendor) Member Information:

  172. Vendors who are ASP Associate Members in good standing are hereby given 
  173. permission to distribute Cascoly Shareware in accordance with the 
  174. Distribution Restrictions listed above.  ASP Associate Members (often called 
  175. "ASP Approved Vendors") in good standing do not need to request permission 
  176. to distribute this package.  ASP vendors who use rack vending or who wish 
  177. to publish our programs as part of a CD-ROM, please note the further 
  178. restrictions outlined below. 
  179.  
  180. This permission is in effect until or unless we notify you otherwise, in 
  181. writing. 
  182.  
  183. ASP Vendor Members - Disk Sets:

  185. ASP Vendor Members who wish to distribute Cascoly Shareware as part of a 
  186. collection (such as PsL's MegaDisk set) may do so provided that all the 
  187. other restrictions are met.

  189. Other (Non-ASP) Disk Vendor Information:
  190. ----------------------------------------
  191. Shareware Distributors and Disk Vendors who are not ASP Associate Members, 
  192. but who wish to distribute Cascoly Shareware need to comply with the 
  193. following additional restrictions.

  195. In order for us to ensure that only current versions are distributed, we 
  196. require that you send us a letter requesting permission to distribute any of 
  197. our products.  
  198.  
  199. You may not list any of our products in advertisements, catalogs, or other 
  200. literature which describes our products as "FREE SOFTWARE".  Shareware is 
  201. "Try-Before-You-Buy" software, it is not free. Please include in your 
  202. letter, a copy of your catalog.  If you are a new vendor, and no catalog is 
  203. available, we need your written assurance that the ASP guidelines for 
  204. vendors are being met -- ie, your catalog must emphasize that users must 
  205. register and pay for shareware they receive from you.

  207. Other (Non-ASP) Vendors - Disk Sets:

  209. Vendors (non-ASP Vendor Members) who wish to distribute any Cascoly 
  210. Shareware as part of a collection (such as PsL's MegaDisk set) must obtain 
  211. written permission from Cascoly Software prior to beginning such a 
  212. distribution.

  214. Computer Clubs and User Groups :
  215. ------------------------------
  216. Computer Clubs and User Groups wishing to add Cascoly Shareware packages to 
  217. their disk library may do so in accordance with the Distribution 
  218. Restrictions listed above. 
  219.  
  220. Disk-of-the-Month (or Subscription) Distribution:
  221. -------------------------------------------------
  222. If you would like to distribute Cascoly Shareware as a Disk-of-the-Month, or 
  223. as part of a subscription or monthly service, then the following 
  224. restrictions apply: 
  225.  
  226. ASP Associate (Disk Vendor) Members in good standing are hereby given 
  227. permission to distribute Cascoly Shareware under the Disk-of-the-Month style 
  228. of distribution. 
  229.  
  230. Others (non-ASP Members) must contact us in advance to ensure that you have 
  231. the most current version of the software. 
  232.  
  233. You cannot use a Disk-of-the-Month distribution to use up your inventory of 
  234. old (out of date) disks.  Only current versions may be shipped as Disk-of-
  235. the-Month disks.

  239. ****** Attention All RACK VENDORS & CD-ROM publishers *******

  242. It has come to our attention that shareware racks may be hurting Cascoly 
  243. Software sales because shareware racks may compete with the low-priced 
  244. retail racks on which our products are sold, and which pay us a royalty. 
  245. Obviously this creates a problem for us.  So starting today (21 Aug 1992), I 
  246. must prohibit all Cascoly, including both current games and our forthcoming 
  247. titles, from being sold on shareware racks of any kind.  Please understand 
  248. that this step is taken purely to protect royalties we are earning.  It 
  249. boils down to the fact that our royalties are much greater than sales we see 
  250. from shareware sold on racks. 
  251.  
  252. Cascoly requests a minimum of $.10 royalty per program sold for any rack 
  253. sales, payable quarterly.  To minimize bookkeeping, Cascoly also licenses 
  254. disks in advance.  You can license any combination of Cascoly programs, in 
  255. lots of 500 for a 20% discount (ie, $40/ 500 programs).  This discounted 
  256. payment is due in advance and is non-refundable.  After each lot of 500 
  257. disks is sold, a new license prepayment is required.  Please send a SASE to 
  258. Cascoly to receive copies of the royalty agreement.

  260. This affects CDROM and rack sales of shareware only, not catalog sales, 
  261. shareware sold at computer swap meets, BBS distribution, etc.  We are 
  262. pleased when any vendor carries our shareware in catalogs, or sells disks 
  263. containing Cascoly products in any way other than rack sales in retail 
  264. locations.
